De procedure sleepte zestien maanden aan, maar de terrorist kreeg uiteindelijk gelijk. De man rechtvaardigde zijn aanvraag op basis van het risico op foltering dat hij loopt in zijn land van herkomst.
Het commissariaat-generaal voor de vluchtelingen zal beroep aantekenen bij de Raad van State.
